GENERAL TERMS AND CONDITIONS OF PARTICIPATION IN ACTIONS

These General Terms and Conditions of Participation in Events (hereinafter referred to as "GTC") apply to participants in all events organized by the company:

Article 1 - Definitions
DT Bike Promotion Fahrertrainings GmBH is a German trading company - motorcycle agency with a long tradition in organizing motorcycle events on and off racing circuits, hereinafter referred to as "Bike Promotion".
R MOTO Radek Matoška sro is a Slovak trading company that cooperates commercially with "Bike Promotion" and which also organizes motorcycle events on its own - also referred to as R MOTO Academy, hereinafter referred to as "R MOTO Radek Matoška sro"
An event is a motorcycle event, such as: training, race, driving lessons, test, etc., which is further specified on the R MOTO Radek Matoška sro website: www.rmoto.sk, hereinafter referred to as the "event". The event is organized by either "Bike Promotion" or "R MOTO Radek Matoška sro". In the event that the event is organized by "Bike Promotion", "R MOTO Radek Matoška sro" has the status of a sales representative in relation to the participant, who negotiates the conclusion of a contract between the participant and "Bike Promotion".
A participant in the event is a person listed as a participant in the event application submitted via the R MOTO Radek Matoška sro website: www.rmoto.sk, hereinafter referred to as the “participant”.
Article 2 – Registration for the event
The application for the event contains basic information about the event: date, venue, participation fee, and other instructions for registration. The application is considered a proposal to conclude a contract pursuant to Section 43a, paragraph 1 of the Civil Code. The participant sends the completed application for the event electronically via the website: www.rmoto.sk
Final confirmation of the application is considered acceptance of the proposal to conclude a contract within the meaning of Section 43c, Paragraph 1 of the Civil Code.
The contractual relationship arises between:
participants and "Bike Promotion", if the participant registers for an event organized by "Bike Promotion"
participants and "R MOTO Radek Matoška sro", if the participant registers for an event organized by "R MOTO Radek Matoška sro"
After sending the application form by the participant via the website www.rmoto.sk, the participant will immediately receive an information e-mail - the so-called confirmation of registration of the application, which also includes the payment terms for payment of the participation fee. Confirmation of registration of the application means that "Bike Promotion" or "R MOTO Radek Matoška sro" records the participant's application in its system, but does not establish a legal right to participate in the event for the participant, since the legal right to participate in the event arises for the participant only after "Bike Promotion" or "R MOTO Radek Matoška sro" has credited the payment in the amount of the participation fee to its account.
The contractual relationship ends when one of the following conditions is met:
by ending the action,
by withdrawing from the contractual relationship according to the cancellation conditions specified in points 9 and 10,
cancellation or early termination of the event for reasons for which the organizer - Bike Promotion" or "R MOTO Radek Matoška sro" is not responsible, i.e. objective cases that led to the cancellation of the event, in which case the participant is not entitled to a refund of the participation fee, not even part of it.
The participant is obliged to truthfully provide other information about themselves in the application, e.g. about the participant's health problems (allergies, illnesses) and the like.
Bike Promotion" or "R MOTO Radek Matoška sro" will send the participant in writing (usually by e-mail) no later than two days before the event date the so-called final confirmation of the application together with organizational instructions to the participant's address specified in the application. This final confirmation of the application establishes the participant's legal right to participate in the event for which he/she has registered, and contains the following:
telephone number of the contact person,
date and time of the start and end of the event,
instructions for arriving at and leaving the event,
information about shared transport (if organized).
The participation fee is listed separately for each type of event on the website: www.rmoto.sk, where it is precisely defined what the participation fee includes. The participant will pay the participation fee immediately after sending the application according to the conditions for payment, which will be stated in the e-mail sent by "Bike Promotion" or "R MOTO Radek Matoška sro" to the participant.
Conditions for cancellation of participation in the event - valid for the contractual relationship established between the participant and "R MOTO Radek Matoška sro":
The start of the event is understood to be the opening of the formal screening, within which the participant registers for the event, on the first day of the event in question.
cancellation of participation in the event within 30 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 15% of the price of the participation fee, which he will receive in the form of a voucher for another event and which is valid for 1 calendar year
cancellation of participation in the event within 20 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 50% of the price of the participation fee, which he will receive in the form of a voucher for another event and which is valid for 1 calendar year
cancellation of participation in the event within 10 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 0% of the price of the participation feeCancellation of participation in the "R MOTO Radek Matoška sro" event is accepted only if it is sent in writing to the e-mail address: info.academy@rmoto.sk
Conditions for cancellation of participation in the event - valid for the contractual relationship established between the participant and "Bike Promotion":
The start of the promotion is understood to be 1 calendar day immediately preceding the date of the promotion (e.g. the promotion is on 28-29.06.2018, the start of the promotion for the purposes of these provisions on cancellation conditions is understood to be 27.06.2018), therefore:
cancellation of participation in the event within 90 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 25 EUR
cancellation of participation in the event within 30 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of EUR 50
cancellation of participation in the event within 15 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 50%, which he or she will receive in the form of a voucher for another event and which is valid for 1 calendar year.
"Bike Promotion" allows the participant to purchase the so-called CANCELLATION INSURANCE for a price of EUR 15 for each day of the event, where in the event that the participant cancels his/her participation in the event, the participant is entitled to a refund of the participation fee in the following scope:
cancellation of participation in the event within 60 days before the start of the event - the participant is entitled to a refund of 100% of the participation fee,
cancellation of participation in the event within 15 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 25 EUR
cancellation of participation in the event within 10 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 100% of the participation fee, which will be provided to him in the form of a voucher for another event and which is valid for 1 calendar year
cancellation of participation in the event within 5 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 75% of the participation fee, which will be provided to him in the form of a voucher for another event and which is valid for 1 calendar year
cancellation of participation in the event from 4 days before, until the start of the event - the participant is entitled to a refund of the participation fee in the amount of 50% of the participation fee, which will be provided to him in the form of a voucher for another event and which is valid for 1 calendar year
Cancellation of participation in the "Bike Promotion" event is accepted only if it is sent in writing to the e-mail address: info@bike-promotion.com.
Article 3 – Insurance on the share
If a contractual relationship arises between the participant and "Bike Promotion", the participant is obliged to give consent to the conclusion of insurance for the event, the insurance premium being already included in the participation fee. The participant gives this consent during the so-called formal check-in, when the participant essentially registers for the event. This insurance covers liability for damage caused to the life and health of other participants.
The insurance does not cover damages that arise as a result of the participant leaving his motorcycle to an unregistered participant at the event, or to any third parties. The participant is obliged to issue a declaration to “Bike Promotion” confirming that he is the holder of valid health insurance abroad, unless the event takes place in his home country. The participant has the option of taking out additional accident insurance. Information about this must be delivered to “Bike Promotion” no later than 1 day before the start of the event.
If a contractual relationship arises between the participant and R MOTO Radek Matoška sro, the participant acknowledges that, if interested, he must arrange insurance for damages incurred at the event individually, i.e. "R MOTO Radek Matoška sro" does not ensure the conclusion of insurance for his events.
Article 4 – Participant’s liability
The participant is obliged to complete the so-called formal inspection, i.e. the stage where the participant de facto registers for the event, and at the same time the technical inspection, during which the condition of the participant's motorcycle, their clothing, etc. is checked.
The participant acknowledges that participation in the event is only permitted on a safe motorcycle. The safe condition of the participants' motorcycles and clothing is checked during the technical inspection before the event. If deficiencies are found, participation in the event may be denied. In this case, the participant is not entitled to a refund of the participation fee, not even part of it.
If a participant endangers the life and health of other participants through risky, reckless driving, "Bike Promotion" or "R MOTO Radek Matoška sro" has the right to exclude them from the event, without any right to a refund of the participation fee or part thereof.
If a participant intentionally causes permanent damage to the race track or race track equipment (especially burn-outs, etc.), he/she shall be solely responsible for this, up to the amount of the damage caused. This also applies to the fastening of nails, dowels, screws, pins, etc. to the reinforced surface in the driver's park and in the floors and walls of the pits.
The participant is obliged to meet all special conditions in order to be able to participate in the event, such as being the holder of a valid driving license for the given type of motorcycle. Within the framework of the event, the participant is obliged to comply with the rules of the road and other legislative requirements for riding in the respective country.
Art. 5 – Transponder – applies only to events organized by “Bike Promotion”
The participant is required to be equipped with a transponder at the “Bike Promotion” events. The registration of lap times is only used to check the correct classification in groups and not for sports comparison. Non-disclosure of this registration must be explicitly requested by the relevant participant in the application. In cup and championship competitions with races, the times of all participants are published. Non-disclosure must be explicitly requested by the relevant participant in the application. Transponders are handed over against retention of a deposit. In the event that the transponder is damaged or lost during use, the participant will be charged for the costs incurred (in the event of loss, this is EUR 430 gross). In the event that the transponder is mistakenly taken home, the organizer - “Bike Promotion” will charge a fee of EUR 5 for each day the transponder is retained until the day it is returned.
Article 6 – Technical requirements
The motorcycle on which the participant will participate in the event must meet the following requirements:
Mirrors, cases and other protruding parts must be removed, sharp edges (e.g. sawn-off frame tubes) are not permitted or must be removed accordingly.
The headlights and turn signals should be removed, otherwise they must be carefully taped over.
exhausts are used at your own discretion. The noise from them must not exceed the value valid for the respective race track (e.g. 98 dB Lausitzring, 95 dB Hockenheim). Exclusion if the values stated are exceeded does not entitle you to a refund of the entry fee. Interruptions of events or longer breaks for noise control are possible if several participants simultaneously violate the noise regulations.
The choice of tires is up to the participant. Their degree of wear must allow for safe participation.
"Bike Promotion" or R MOTO Radek Matoška sro" reserves the right to exclude from the event those vehicles that do not comply with the technical rules.
The participant acknowledges that he/she will not be allowed to participate in the event if his/her motorcycle does not have functioning brakes or an approved muffler. After a fall, the participant must re-submit his/her vehicle to technical inspection.
Article 7 – Participant clothing requirements
Each participant is required to wear additional back protectors, unless such protector is already built into the suit. Only participants wearing protective clothing that complies with the regulations (undamaged full-face helmet, leather suit, leather boots, leather gloves) may be admitted to the event.
Art. 8 – Bib number requirement – applies only to events organized by “Bike Promotion”
Each participant must mark his motorcycle with a start number. The start number will be announced at the latest at the start of the event, but usually already with the confirmation of participation. Special wishes for start numbers can be taken into account, but they must be stated in the application. The participant is not entitled to a specific start number. Start numbers must be attached in a clearly visible way at the front, as well as on the left and right sides of the vehicle. The start numbers must be at least 12 cm high. They must be attached to the vehicle in a clearly legible way, otherwise participation on the course may be refused.
Article 9 – Course of the action
Each participant must attend the so-called formal scrutineering and technical scrutineering before the event begins, otherwise they are not entitled to participate in the event. Each participant must attend the riders' briefing. If they do not attend the riders' briefing, the participant may be disqualified, i.e. not allowed on the track. The riders' briefing will take place at the beginning of the event and possibly before the start of the races of the relevant classes. The event plan will be attached to the final confirmation of the application and also displayed directly at the event location. "Bike Promotion" or R MOTO Radek Matoška sro" reserve the right to change the event schedule.
The participant is obliged to carry out a formal and technical inspection at a location specifically designated by "Bike Promotion" or R MOTO Radek Matoška sro".
Article 10 – Security conditions
Entry into safety areas, especially crash zones, is strictly prohibited for any participant. This also includes the pit lane. During the event, especially the race, only the driver's assistants - participants - are allowed to enter the pit lane. Smoking is absolutely prohibited in the pit lane! The pit lane is one-way! You may only drive slowly in the pit lane. In the driver's park, walking speed applies to all vehicles! Failure to comply will result in immediate disqualification or expulsion from the event. Children under the age of 14 are strictly prohibited from driving in the driver's park and in the pits/pit lane. Children under the age of 14 are also strictly prohibited from staying in the pit lane. Pets are prohibited on the race tracks. The so-called house rules of the respective race track apply to each individual event.
Each participant is obliged to follow the instructions of the event management and its representatives. Actions in contradiction and violations of the content of these conditions, especially threats by reckless driving in the riders' park, or failure to respect the flag signs, will lead to the participant's disqualification or exclusion from the event.
Article 11 - Participation in the event at your own risk
The participant participates in the event at his own risk and is fully and seriously aware that riding a motorcycle is generally very dangerous and can cause serious injuries with possible consequences. The participant declares that he is aware of all the risks associated with riding a motorcycle and therefore bears civil and criminal liability for all damage caused by him or the vehicles used by him. By submitting his application, the participant declares that he waives claims of any kind for damage that may arise at the event, against the organizer ("Bike Promotion" or R MOTO Radek Matoška sro"), track service, medical personnel, race track owners, sponsors, race services and other persons who have any connection with the organization of the event, as well as against auxiliary forces in the performance and construction of all the above-mentioned persons and places. At the same time, the participant assumes all risks and consequences associated with riding a motorcycle, i.e. assumes all damages that may potentially arise while riding a motorcycle, namely damages that arise personally to the participant or that he causes to third parties while riding a motorcycle, in particular damages to health: physical and psychological suffering, pain, anxiety, trauma, illness, death, as well as damages that arise to property and damages of any other kind, whether caused by the participant himself or a third party, namely negligence or other error when riding a motorcycle, defective motorcycle construction, defective motorcycle production, contact with another participant while riding a motorcycle, or any other objects, the influence of the weather, or other circumstances.
The participant himself is responsible for the fact that he will be the only one driving the motorcycle at the event for which he has registered. In the event that an unregistered rider drives the motorcycle on the event route, the participant is liable for any damage caused in full. In addition, "Bike Promotion" or R MOTO Radek Matoška sro" has the right to impose a fine of EUR 500 on the participant who has violated this obligation, i.e. whose motorcycle was used in this way. The fine is payable within 5 days from the date of the violation of the obligation in question by the participant.
Article 12 – Personal data
By submitting an application, the participant voluntarily provides the organizer - "Bike Promotion" or "R MOTO Radek Matoška sro" with their personal data specified in the application (hereinafter referred to as "personal data"). The personal data that the participant provides to the organizer - "Bike Promotion" or "R MOTO Radek Matoška sro" in the application will be processed in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data, as amended (hereinafter referred to as the "Act"). The legal basis for this processing is a contractual relationship. The participant may allow the processing of personal data in another manner or for other purposes by additional consent. The organizer will publish information on its website about the processing of personal data pursuant to Section 19 of Act No. 18/2018 Coll.
Article 13 - Final provision
General terms and conditions of participation are published on the website: "R MOTO Radek Matoška sro" and are valid from June 6, 2018.
By submitting a binding application for the event, the participant expressly declares that he/she agrees with these general terms and conditions of participation and undertakes to comply with all conditions imposed on the participant under these terms and conditions.
Changes to these general terms and conditions of participation are valid and binding for registration for events after their publication on the R MOTO Radek Matoška sro website.
Both contracting parties declare that the content of these General Conditions of Participation is clear, definite, and understandable to them, and they undertake to comply with them.
