These General Conditions of Participation in Events (hereinafter referred to as "GTC") apply to participants of all events organized by the company:

Art. 1 - Definition of terms
DT Bike Promotion Fahrertrainings GmBH is a German trading company - a motorcycle agency with a long tradition in organizing motorcycle events on and off the racing circuit, hereinafter referred to as "Bike Promotion".
R MOTO Radek Matoška s.r.o. is a Slovak trading company that cooperates commercially with "Bike Promotion" and which itself organizes motorcycle events - also known as R MOTO Academy, hereinafter referred to as "R MOTO Radek Matoška s.r.o."
An event is a motorcycle event, for example: training, race, driving lesson, test, etc., which is specified in more detail on the website of R MOTO Radek Matoška s.r.o.: www.radekmatoska.sk, hereinafter referred to as the "event". The event is organized by either "Bike Promotion" or "R MOTO Radek Matoška s.r.o." In the event that the event is organized by "Bike Promotion", "R MOTO Radek Matoška s.r.o." has the status of a business representative in relation to the participant, who negotiates the conclusion of the contract between the participant and "Bike Promotion".
The participant of the event is the person who is listed as a participant in the application for the event, which was sent through the website of R MOTO Radek Matoška s.r.o.: www.radekmatoska.sk, hereinafter referred to as "participant".
Art. 2 – Registration for the event
The application for the event contains basic information about the event: date, venue, participation fee, or other instructions for registration. The application is considered a proposal to conclude a contract in accordance with § 43a par. 1 of the Civil Code. The participant sends the completed application for the event electronically via the website: www.radekmatoska.sk
The final confirmation of the application is considered to be the acceptance of the proposal for the conclusion of the contract in accordance with § 43c par. 1 of the Civil Code.
A contractual relationship arises between:
participants and "Bike Promotion", if the participant signs up for an event organized by "Bike Promotion"
participants and "R MOTO Radek Matoška s.r.o.", if the participant registers for an event organized by "R MOTO Radek Matoška s.r.o."
After sending the application by the participant via the website www.radekmatoska.sk, the participant will be immediately sent an information e-mail - the so-called confirmation of the registration of the application, which also includes the payment conditions for paying the participation fee. Confirmation of application registration means that "Bike Promotion" or "R MOTO Radek Matoška s.r.o." registers the participant's application in its system, but does not establish a legal right to participate in the event for the participant, as the legal right to participate in the event arises for the participant only after "Bike Promotion" or "R MOTO Radek Matoška s.r.o." will have a payment in the amount of the participation fee credited to its account.
The contractual relationship ends when one of the following conditions is met:
by ending the event,
withdrawing from the contractual relationship according to the cancellation conditions specified in points 9 and 10,
cancellation or premature termination of the event for reasons for which the organizer - Bike Promotion" or "R MOTO Radek Matoška s.r.o." is not responsible, i.e. objective cases that led to the cancellation of the event, in which case the participant is not entitled to a refund of the participation fee, namely nor its parts.
The participant is obliged to truthfully provide additional information about himself in the application, e.g. about health problems of the participant (allergies, diseases) and the like.
Bike Promotion" or "R MOTO Radek Matoška s.r.o." will send the participant in writing (usually by e-mail) no later than two days before the date of the event, the so-called final confirmation of the application together with organizational instructions to the participant's address stated in the application. This final confirmation of the application establishes the participant's legal right to participate in the event for which he has applied, which includes:
telephone number for the contact person,
date and time of the start and end of the event,
instructions for arriving at and leaving the event,
information about public transport (if organized).
The participation fee is listed separately for each type of event on the website: www.radekmatoska.sk, where it is precisely defined what the participation fee includes. The participant will pay the participation fee immediately after sending the application according to the conditions for making the payment, which will be stated in the e-mail sent by "Bike Promotion" or "R MOTO Radek Matoška s.r.o." to the participant.
Conditions for cancellation of participation in the event - valid for the contractual relationship established between the participant and "R MOTO Radek Matoška s.r.o.":
The beginning of the event is understood as the opening of the formal check-in, during which the participant registers for the event, on the first day of the event in question.
cancellation of participation in the event up to 30 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 15% of the price of the participation fee
cancellation of participation in the event up to 15 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of 20% of the price of the participation fee
cancellation of participation in the event up to 5 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee in the amount of 80% of the price of the participation fee, which he receives in the form of a voucher for another event and which is valid for 1 calendar year.
Cancellation of participation in the "R MOTO Radek Matoška s.r.o." event is accepted only if it is sent in writing to the e-mail address: info.academy@rmoto.sk
Conditions for cancellation of participation in the event - valid for the contractual relationship established between the participant and "Bike Promotion":
The beginning of the promotion is understood to be 1 calendar day immediately preceding the day when the promotion is due (e.g. the promotion is on 28.06.29.2018, the beginning of the promotion is understood to be 27.06.2018 for the purposes of these provisions on cancellation conditions), therefore:
cancellation of participation in the event up to 90 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of EUR 25
cancellation of participation in the event up to 30 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of EUR 50
cancellation of participation in the event up to 15 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 50%, which he or she will receive in the form of a voucher for another event and which is valid for 1 calendar year.
"Bike Promotion" allows the participant to purchase the so-called CANCELLATION INSURANCE at a price of EUR 15 for each day of the event, when in the event that the participant cancels his participation in the event, the participant is entitled to a refund of the participation fee to the following extent:
cancellation of participation in the event within 60 days before the start of the event - the participant is entitled to a refund of 100% of the participation fee,
cancellation of participation in the event up to 15 days before the start of the event - the participant is entitled to a refund of the participation fee after deducting a cancellation fee of EUR 25
cancellation of participation in the event up to 10 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 100% of the participation fee, which will be provided to him in the form of a voucher for another event and the validity of which is 1 calendar year
cancellation of participation in the event up to 5 days before the start of the event - the participant is entitled to a refund of the participation fee in the amount of 75% of the participation fee, which will be provided to him in the form of a voucher for another event and the validity of which is 1 calendar year
cancellation of participation in the event from 4 days before until the beginning of the event - the participant is entitled to a refund of the participation fee in the amount of 50% of the participation fee, which will be provided to him in the form of a voucher for another event and the validity of which is 1 calendar year
Cancellation of participation in the "Bike Promotion" event is accepted only if it is sent in writing to the e-mail address: info@bike-promotion.com.
Art. 3 – Insurance for the event
If a contractual relationship is established between the participant and "Bike Promotion", the participant is obliged to give consent to take out insurance for the event, while the insurance premium is already included in the participation fee. The participant gives this consent in the so-called formal screening, when basically the participant registers for the event. This insurance covers liability for damages caused to the life and health of other participants.
The insurance does not cover damages that arise as a result of the participant leaving his motorcycle to an unregistered participant at the event, or to any third parties. The participant is obliged to issue a "Bike Promotion" statement confirming that he is the holder of valid health insurance abroad, unless the event is taking place in his home country. The participant has the option to take out additional accident insurance. Information about this must be delivered to "Bike Promotion" no later than 1 day before the start of the event.
If a contractual relationship arises between the participant and R MOTO Radek Matoška s.r.o., the participant acknowledges that if he is interested, he must arrange insurance for damages incurred at the event individually, i.e. "R MOTO Radek Matoška s.r.o." does not provide insurance for his events.
Art. 4 – Participant's responsibility
The participant is obliged to complete the so-called a formal check-up, i.e. the state when the participant de facto registers for the event, and at the same time a technical check-up, during which the condition of the participant's motorcycle, his clothes, etc. are checked.
The participant acknowledges that participation in the event is permitted only on a motorcycle that is safe to ride. The roadworthy condition of the participants' motorcycles and participants' clothing is checked during the technical inspection before the event. Participation in the event may be refused if deficiencies are found. In this case, the participant is not entitled to a refund of the participation fee, not even its part.
If a participant endangers the life and health of other participants by a risky, reckless way of driving, "Bike Promotion" or "R MOTO Radek Matoška s.r.o." has the right to exclude him from the event, without the right to refund the participation fee, or its parts.
If a participant intentionally causes permanent damage to the race track or to the race track equipment (especially burn-out, etc.), he alone bears full responsibility for this, in the amount of the damage caused. This also applies to fastening nails, dowels, screws, pins, etc. into the reinforced base in the riders' park and in the floors and walls of the boxes.
The participant is obliged to meet all special conditions in order to be able to participate in the event, e.g. be the holder of a valid driver's license for the given type of motorcycle. As part of the event, the participant is obliged to comply with road traffic rules and other legislative requirements for driving in that country.
Art. 5 – Transponder – applies only to events organized by "Bike Promotion"
The participant is obliged to be equipped with a transponder at the "Bike Promotion" events. Registration of lap times serves only to check the correct classification in groups and not for sports comparison. Non-publication of this registration must be explicitly requested by the relevant participant in the application. For cup and championship competitions with races, the times of all participants are published. Non-publication must be explicitly requested by the relevant participant in the application. Transponders are surrendered against retention of bail. In the event that the transponder is damaged or lost during use, the participant will be billed for the incurred costs (in case of loss, it is EUR 430 gross). In the event that the transponder is taken home by mistake, the organizer - "Bike Promotion" will charge a fee of EUR 5 for each day the transponder is kept until the day it is returned.
Art. 6 – Technical requirements
The motorcycle on which the participant will participate in the event must meet the following requirements:
mirrors, trunks and other protruding parts must be removed, sharp edges (e.g. sawn off frame tubes) are not allowed, or they must be removed accordingly.
reflectors and turn signals should be removed, otherwise they must be carefully taped.
exhausts are used at your discretion. The noise from them must not exceed the value valid for the respective racing track (e.g. 98 dB Lausitzring, 95 dB Hockenheim). Exclusion in case of exceeding the stated values does not entitle to a refund of the entry fee. Interruptions of events, or longer breaks to control the noise level are possible when several participants are in violation of the noise level regulations at the same time.
the choice of tires is up to the participant. Their level of wear must allow safe participation.
"Bike Promotion" or R MOTO Radek Matoška s.r.o. reserves the right to exclude from the event those vehicles that do not comply with the technical rules.
The participant acknowledges that he will not be admitted to the event if his motorcycle does not have functional brakes or does not have an approved silencer. After the crash, the participant must submit his vehicle to a technical examination again.
Art. 7 – Participant clothing requirements
Each participant of the event is obliged to wear additional back protectors, unless such a protector is already built into the overalls. Only those participants who wear protective clothing complying with the regulations (undamaged full-face helmet, leather overalls, leather boots, leather gloves) may be admitted to the event.
Art. 8 - Starting number requirement - only valid for events organized by "Bike Promotion"
Each participant must mark his motorcycle with a starting number. The starting number will be announced at the start of the event at the latest, but usually already with the confirmation of participation. Special wishes of starting numbers can be taken into account, but it is necessary to state them in the application. The participant is not entitled to a specific start number. Start numbers must be affixed in a clearly visible manner at the front, as well as on the left and right sides of the vehicle. The height of the starting numbers must be at least 12 cm. They must be attached to the vehicle in a clearly legible manner, otherwise participation on the track may be refused.
Art. 9 – Course of action
Each participant must participate before the start of the so-called event. the formal screening and also the technical screening, otherwise he does not have the right to enter the event. Each participant must attend the riders' meeting. If the participant does not participate in the drivers' meeting, he may be disqualified, ie not allowed on the track. The drivers' meeting will take place at the beginning of the event and possibly before the start of the races of the respective classes. The plan of the event will be attached to the final confirmation of the application and also displayed directly at the location of the event. "Bike Promotion" or R MOTO Radek Matoška s.r.o. reserve the right to make changes to the schedule of the event.
The participant is obliged to carry out a formal and technical examination at a place precisely specified by "Bike Promotion" or R MOTO Radek Matoška s.r.o.
Art. 10 – Safety conditions
Entering the safety areas, especially the drop zones, is strictly prohibited for any participant. The alley of boxes also belongs here. During the event, especially the race, only assistant riders - participants are allowed to enter the pit lane. Smoking is strictly prohibited in the pit lane! The alley of boxes is one-way! You may only drive slowly in the pit lane. In the driver's park, the walking speed applies to all vehicles! Failure to comply will result in immediate disqualification, or to report from the event. Driving of children under the age of 14 in the rider park and in the pits/alley is strictly prohibited. Children under the age of 14 are also strictly prohibited from staying in the pit lane. Pets are prohibited on the race tracks. At each individual event, the so-called house rules of the respective racing track.
Each participant is obliged to follow the instructions of the management of the event and its representatives. Actions contrary to and violations of the content of these conditions, especially threats by reckless driving in the riders' park, or disrespecting the flag signs lead to the disqualification of the participant, or to his exclusion from the action.
Art. 11 - Participation in the event at your own risk
The Participant participates in the event at his own risk and is fully and seriously aware that riding a motorcycle in general is very dangerous and can cause serious injuries with possible consequences. The Participant declares that he is aware of all the risks associated with riding a motorcycle and therefore bears civil and criminal liability for all damages caused by him or the vehicles used by him. By sending his application, the participant declares that he waives claims of any kind for damages arising from the event, against the organizer (Bike Promotion" or R MOTO Radek Matoška s.r.o."), track service, medical staff, owners of the race track, sponsors, race officials services and other persons who have any connection with the organization of the event, as well as to auxiliary forces in the fulfillment and preparation of all the above-mentioned persons and places. At the same time, the participant assumes all risks and consequences associated with riding a motorcycle, i.e. he assumes all damages that may potentially occur while riding a motorcycle, namely damages that the participant personally incurs or that he causes while riding motorcycles to third parties, especially damage to health: physical and mental suffering, pain, anxiety, trauma, illness, death, as well as damage to property and damage of any other kind, whether caused by the participant himself or a third party, namely through negligence, or other mistake while riding a motorcycle, faulty construction of a motorcycle, faulty production of a motorcycle, contact with another participant while riding a motorcycle, or any other objects, due to the weather, or other circumstances.
The participant himself is responsible for the fact that he will exclusively drive the motorcycle at the event he signed up for. In the event that a motorcycle is driven by an unregistered rider on the course of the event, the participant is responsible for any damage caused in full. In addition, "Bike Promotion" or R MOTO Radek Matoška s.r.o. has the right to impose a fine of EUR 500 on the participant who violated this obligation, i.e. whose motorcycle was used in this way. The monetary fine is payable within 5 days from the date of violation of the relevant obligation by the participant.
Art. 12 – Personal data
By submitting the application, the participant voluntarily provides the organizer - "Bike Promotion" or R MOTO Radek Matoška s.r.o. with their personal data specified in the application (hereinafter referred to as "personal data"). Personal data that the participant provides to the organizer - "Bike Promotion" or "R MOTO Radek Matoška s.r.o." in the application will be processed in accordance with Act no. 18/2018 Coll. on the protection of personal data as amended (hereinafter "the Act"). The legal basis for this processing is a contractual relationship. The processing of personal data in a different way or for other purposes can be permitted by the participant with additional consent. The organizer will publish on its website information about the processing of personal data in accordance with § 19 of Act no. 18/2018 Z. .
Art. 13 - Final provision
The general conditions of participation are published on the website: "R MOTO Radek Matoška s.r.o." and are valid from June 6, 2018.
By sending a binding application for the event, the participant expressly declares that he agrees with these general terms and conditions of participation and undertakes to comply with all conditions imposed on the participant according to these terms.
Changes to these general conditions of participation are valid and binding for registering for events after they are published on the R MOTO Radek Matoška s.r.o. website.
Both contracting parties declare that the content of these General Conditions of Participation is clear, specific and understandable to them and they undertake to comply with them.
